At the Chambers Law Offices, we provide representation and advice to clients who request asylum. If you are bringing an asylum claim, or have had your claim denied, call the Chambers Law Offices to speak with an experienced immigration lawyer.
The law governing asylum cases reads, in part--
"An applicant shall be found to be a refugee on the basis of past persecution if he or she can establish that he or she has suffered persecution in the past…on account of race, religion, nationality, membership in a particular social group, or political opinion, and that he or she is unable or unwilling to return... "
Code of Federal Regulations 203.13(b)(1) (emphasis added)
Many people come to the United States seeking asylum. Unfortunately, even though their circumstances may seem obvious to them, proving their case may be difficult under the law. Most of the people who request affirmative asylum are denied. Once they receive an asylum denial, the Immigration and Customs Enforcement (ICE) puts them in removal proceedings. If you are in removal proceedings, you need a qualified advocate who knows how to frame your case to provide you with the relief you are seeking.
Has your request for asylum been denied?
Do you face persecution, but have a criminal conviction? You may have options. You may be able to invoke the Convention against Torture (CAT), and request a deferral of removal. With a deferral, you will not be forced to return as long as adverse conditions in your country persist.
